By accessing or using the website located at thefieldwisegroup.com (the "Site"), operated by The Fieldwise Group, LLC ("Fieldwise," "I," "me," or "my"), a Tennessee limited liability company, you ("you" or "User") agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, please do not use this Site.
Fieldwise provides business operations consulting and implementation services to established trade and service businesses. Descriptions of services on this Site are provided for general informational purposes and do not constitute an offer to enter into a binding agreement. Any actual engagement for consulting services will be governed by a separate, signed written agreement between Fieldwise and the client, which will control over any conflicting terms described on this Site.
Fieldwise may offer a complimentary introductory call ("Discovery Call") to prospective clients. The Discovery Call is provided for general informational and educational purposes only. Participation in a Discovery Call does not create, and should not be interpreted as creating, any contractual relationship, partnership, joint venture, agency, or fiduciary relationship between you and Fieldwise. No advice given during a Discovery Call should be relied upon as professional, financial, operational, or legal advice specific to your business, and no attorney-client, consultant-client, or similar professional relationship is formed until a separate written services agreement is executed by both parties.
Where Fieldwise and a client enter into a paid engagement, payment terms, including any combination of retainer fees, deposits, and upfront or milestone-based payments, will be set forth in a separate written services agreement specific to that engagement. General pricing information presented on this Site is illustrative only, is subject to change without notice, and does not constitute a binding quote or offer. All fees for services rendered are generally non-refundable except as expressly stated in a signed services agreement.
Consulting and operational improvement outcomes depend on numerous factors specific to each business, including factors outside of Fieldwise's control. Fieldwise makes no warranty or guarantee, express or implied, regarding specific financial results, operational outcomes, or business performance arising from its services. Testimonials, examples, or general statements about potential outcomes described on this Site are illustrative and not a guarantee of similar results for any particular business.
Fieldwise treats information shared by prospective and current clients as confidential and does not disclose client identities, business information, or engagement details to third parties, except as required by law or as otherwise agreed in writing. Specific confidentiality obligations for a paid engagement will be detailed in the applicable services agreement.
Any services provided by Fieldwise are provided as an independent contractor. Nothing in these Terms or in any services agreement shall be construed to create an employer-employee relationship, partnership, or joint venture between Fieldwise and any client.
All content on this Site, including text, graphics, logos, and design elements, is the property of The Fieldwise Group, LLC or its licensors and is protected by applicable intellectual property laws. Materials, frameworks, documentation, or deliverables created during a paid engagement will be governed by the ownership terms specified in the applicable services agreement.
To the fullest extent permitted by applicable law, The Fieldwise Group, LLC, its owner, and its representatives shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of this Site or any Discovery Call, whether based on warranty, contract, tort, or any other legal theory. This limitation does not apply to matters that cannot be limited or excluded under applicable Tennessee or federal law.
Information on this Site is provided for general informational purposes only and does not constitute legal, financial, tax, or professional business advice. You should consult with qualified professionals regarding your specific business circumstances before making decisions based on information found on this Site.
These Terms shall be governed by and construed in accordance with the laws of the State of Tennessee, without regard to its conflict of law principles, and, where applicable, the laws of the United States. Any dispute arising out of or relating to these Terms or the use of this Site shall first be attempted to be resolved through good-faith negotiation between the parties. If a resolution cannot be reached, the parties agree that any dispute shall be subject to the exclusive jurisdiction of the state or federal courts located in Williamson County, Tennessee, unless a separate services agreement specifies a different dispute resolution process, such as mediation or binding arbitration.
Fieldwise shall not be liable for any failure or delay in performance resulting from causes beyond its reasonable control, including but not limited to acts of God, natural disaster, labor disputes, governmental action, or other events of force majeure.
If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.
Fieldwise may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent version. Continued use of this Site after changes are posted constitutes acceptance of the revised Terms.
